The OZERTY.CO.NZ website is owned and operated by MOJO FZ LLC (hereinafter "OZERTY").
OZERTY attaches the greatest importance to the respect of privacy and the protection of personal information, and undertakes to implement appropriate measures to ensure the protection of such information and to process and use it in compliance with applicable laws, in particular the New Zealand Privacy Act 2020.
ARTICLE 1: Agency responsible for the information
Your personal information is collected by OZERTY (MOJO FZ LLC), whose registered office is located at A4-709 Building no.A4, Al Hamra Industrial Zone-FZ, 10055 Ras Al Khaimah, United Arab Emirates, registered under number 45000044.
Within the meaning of the New Zealand Privacy Act 2020, OZERTY acts as the agency responsible for the personal information it collects and determines the purposes for which it is collected and the means by which it is processed.

ARTICLE 2: Information collected and purposes
OZERTY, as the agency responsible for the information, may collect, consult, use, modify, store, transmit and delete personal information within the framework of its commercial and contractual activities.
Within the meaning of the New Zealand Privacy Act 2020, the terms "Information" or "Personal Information" designate any information about an identifiable individual.
An "identifiable individual" is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity.
OZERTY undertakes to collect personal information only for specified, explicit and legitimate purposes connected with its activities, and not to further process such information in a manner incompatible with those purposes.
OZERTY undertakes to process only personal information that is adequate, relevant and not excessive in relation to the purposes for which it is collected.
This information is for the most part collected directly from the individuals concerned when they:
- Create a personal area on the OZERTY website.
- Make an enquiry to OZERTY.
- Place an order on the website.
- Browse the website and/or view the products.
- Contact OZERTY's Customer Service.
Within the framework of the collection activities mentioned above, OZERTY collects the following information:
- Identity data (first name, surname and, where applicable, gender, age, date of birth).
- Contact data (email, postal address, telephone number, social media details).
- Billing data and payment methods.
- Details of the services and subscriptions taken out.
- The history of the contractual relationship.
- A copy of the person's correspondence with customer service.
- Where applicable, responses to surveys and questionnaires and comments/reviews.
- Technical information relating to browsing (e.g.: IP address, browsing history, visit path, browser, operating system, information about the devices from which you access the website...).
It is specified that certain of this information, in particular gender, age or date of birth, is not systematically collected; it is only collected where applicable, when necessary for a specific purpose (for example for the measurement and optimisation of advertising). OZERTY reserves the possibility of collecting it for this purpose in compliance with the principles set out in this policy.
In order to better understand the processing of information carried out by OZERTY, we inform the individuals concerned that OZERTY may process their information for the following purposes:
- Carrying out processing relating to administrative management (customer accounts, orders, deliveries, invoicing, debt recovery).
- Carrying out processing relating to the management of the customer relationship (management of reviews, satisfaction surveys, management of the loyalty programme).
- Carrying out processing relating to the management of complaints (after-sales service, handling of requests for access, correction, objection, deletion, management of disputes).
- Carrying out processing relating to the steering of marketing activity and improvement of the website (traffic analysis, customer targeting, commercial prospecting...).
ARTICLE 3: Hosting and transfers of Information
Personal information may be hosted and processed in New Zealand, as well as in other jurisdictions where OZERTY or its service providers operate.
Where certain information must be processed or accessed outside New Zealand, OZERTY takes reasonable steps, in accordance with the New Zealand Privacy Act 2020, to ensure that the information is protected by comparable safeguards to those provided under that Act. ARTICLE 4: Recipients of the collected Information
Your information is intended for OZERTY. It may be communicated to our providers acting on our behalf for the needs of the Service (in particular hosting of the website, processing of payments, delivery of orders, sending of communications and audience measurement), who act only on our instructions and are not authorised to use it for other purposes. OZERTY may also disclose your information where required to do so by law or in response to a valid request from a competent authority. Apart from these cases, OZERTY does not pass on your information to third parties.
ARTICLE 5: Information retention period
Information is retained for a period appropriate to the purposes of the processing and in accordance with applicable legislation and regulations. OZERTY does not keep personal information for longer than is required for the purposes for which it may lawfully be used.
Information relating to the customer relationship is retained for the entire duration of the contractual relationship, then in an active database for up to three (3) years from the individual's last contact or from the end of the contractual relationship.
At the end of this period, the information necessary to establish, exercise or defend legal claims may be archived, with restricted access, for the applicable limitation period. Accounting records and supporting documents (in particular invoices) are retained for the periods required by applicable tax and company law.
ARTICLE 6: Your rights
In accordance with the New Zealand Privacy Act 2020, every individual has the right to access the personal information that OZERTY holds about them and to request the correction of that information. Where an individual requests a correction and OZERTY does not make it, the individual may ask that a statement of the correction sought be attached to the information.

Individuals also have the right to lodge a complaint with the Office of the Privacy Commissioner (www.privacy.org.nz).
ARTICLE 7: Confidentiality of information and privacy breaches
OZERTY implements reasonable technical and organisational security safeguards to protect personal information against loss, and against any unauthorised access, use, modification or disclosure. In the event of a privacy breach that it is reasonable to believe has caused, or is likely to cause, serious harm to the individuals concerned, OZERTY will, in accordance with the New Zealand Privacy Act 2020, notify the Office of the Privacy Commissioner as well as the affected individuals.
ARTICLE 8: Cookie management policy
A Cookie is a text file placed on your hard drive by the server of the OZERTY website. It generally contains the name of the server that placed it, an identifier in the form of a unique number and an expiry date. Its purpose is to collect information relating to your browsing in order to offer you services adapted to your terminal (computer, mobile or tablet).
On your first visit, a banner allows you to accept or refuse the placement of non-essential cookies. You can change your choices at any time via the parameters provided for this purpose. Non-essential cookies are only placed after obtaining your consent.
8.1 Functional cookies
Functional cookies are necessary for the operation of the website. They allow persons to use the main features of the website and to secure their connection. They can allow direct access to their personal areas. These cookies also allow persons to place products in their shopping basket and to keep their basket active.
These cookies have a very short lifespan, for as long as the session remains active.

Technical performance cookies allow OZERTY to monitor the technical performance of its website, to detect problems in order to reduce as much as possible any inconvenience for the User, to activate and support security features, but also to help detect malicious activities and breaches of these conditions.
The lifespan of technical performance cookies is limited to thirteen months.
Refusing the activation of such cookies or deleting them has no impact on the browsing of persons.
8.4 Audience measurement cookies
Audience measurement and statistics cookies allow OZERTY to know the use and performance of the website, to establish statistics, volumes of traffic and use of various elements (content visited, paths…) in order to improve the interest and ergonomics of the services offered (the most frequently visited pages or sections, the most read articles…). These cookies also serve to measure the consultation traffic of the website.
The lifespan of audience measurement cookies is limited to thirteen months.
Refusing the activation of such cookies or deleting them has no impact on the browsing of persons.
8.5 Advertising cookies
Within the framework of browsing on all the pages of its website, OZERTY may carry out processing of browsing data and/or use advertising cookies in order to offer visitors advertising in line with their interests. These cookies also make it possible to limit the number of times a visitor sees an advertisement and are also used by OZERTY to assess the effectiveness of its advertising campaigns.
The lifespan of advertising cookies is limited to thirteen months.

8.6 Sharing cookies (social networks)
The OZERTY website may include buttons or modules from social networks, such as Facebook and Twitter, which allow visitors to share content with other persons or to inform third parties of your consultation or your opinion regarding content on our website.
